AGB
General Terms and Conditions (GTC) of Niklas Oberhofer Consulting GmbH
1. Scope
These General Terms and Conditions (GTC) apply to all contracts between n.o Consulting & Events GmbH (hereinafter referred to as the "Provider") and the customer. Deviating terms and conditions of the customer shall only apply if they have been expressly agreed upon in writing.
2. Conclusion of Contract
A contract is concluded upon the written acceptance of an offer or the confirmation of a booking by the Provider. Any changes or additions require written form.
3. Scope of Services
The Provider offers customized event and consulting services. The specific scope of services is defined in the respective contract or offer. The customer undertakes to provide all necessary information and requirements in a timely manner.
4. Prices and Payment Terms
Prices are determined by the offer or written agreement. Unless otherwise agreed, the following payment terms apply:

50% deposit upon conclusion of the contract

Remaining balance due no later than 7 days after the event
In case of delayed payment, the Provider reserves the right to charge default interest of 5% above the base rate. Additional reminder fees and collection costs may also apply.
5. Cancellation and Withdrawal
The customer may cancel the contract in writing. The following cancellation fees apply:

Up to 30 days before the event: 25% of the total amount

29 to 15 days before the event: 50% of the total amount

14 to 7 days before the event: 75% of the total amount

Less than 7 days before the event: 100% of the total amount
If the Provider is forced to cancel due to unforeseen circumstances (e.g., force majeure), the customer will be informed immediately. Any payments already made will be refunded, and further claims are excluded.
6. Liability
The Provider is only liable for damages caused by gross negligence or willful misconduct. Liability for consequential damages, lost profits, or indirect damages is excluded.
The customer is responsible for ensuring adequate insurance coverage, especially for events with increased risk.
7. Data Protection and Confidentiality
All information obtained in connection with the contract will be treated confidentially and will not be disclosed to third parties unless there is a legal obligation to do so.
8. Intellectual Property
All concepts, designs, and content created by the Provider are subject to copyright protection. Use or distribution without the express consent of the Provider is prohibited.
9. Expenses and Travel Costs
Travel and accommodation expenses, as well as other costs, will be invoiced separately unless otherwise agreed. The Provider reserves the right to charge a mileage allowance or travel cost reimbursement in accordance with applicable rates.
10. Force Majeure
If the fulfillment of the contract becomes impossible due to force majeure (e.g., natural disasters, pandemics, government regulations), neither party shall be liable for non-performance or delays. Payments already made will be refunded proportionally, considering services already rendered.
11. Final Provisions
Swiss law shall apply.
The place of jurisdiction for all disputes is Zurich, Switzerland.
